Dell & Schaefer Recovers $2.5 million for a 60 Year old Cyclist

Our client, a 60 year old avid cyclist was riding his bicycle on AlA in Palm Beach Florida when he was hit by a car and thrown over 30 feet, causing his right hip and head to hit the pavement on the side of the road.

The driver of the car reported to the police that the bicycle rider turned in front of the car and was at fault for the collision. Client suffered a fractured hip and mild to moderate brain injury as a result of the accident. Due to the severity of his injuries, client spent 1 month in the hospital, as well as 3 months in a neurological rehabilitation facility.

Initially, both insurance companies involved in this case relied on the police accident report and denied responsibility for the plaintiff’s serious injuries.

Florida Bicycle Accident Attorneys Dell & Schaefer hired an accident reconstruction and bicycle experts to examine the accident scene and the damaged bicycle. The accident reconstruction expert was able to establish that the bicycle was hit from behind directly on the back tire causing the rear wheel forks to be bent forward. Both insurance companies also hired experts to examine the bicycle and reported that the accident could not have occurred exactly as reported by the defendant driver to the police.

As a result of Dell & Schaefer Attorneys’ ability to establish substantial liability on the defendant driver, client was able to collect damages for medical bills, pain and suffering, and loss of enjoyment of life. The case was settled for combined bodily injury and underinsured motorist policy limits of 2.5 million dollars.
