Many people believe that if they have been rear-ended by another vehicle, there is no need for them to hire a lawyer because they can simply deal with the Defendant’s insurance company directly. They feel that the insurance company will be fair to them and will compensate them for all of their damages. This is typically not the case. While it may be relatively easy to prove the other party was at fault in a rear-end auto accident, it will not be so easy to prove that all of your damages are the result of the accident.

rearendedIn Florida, a person must be able to prove that they suffered a permanent injury as the result of an auto accident in order to be victorious in a claim for certain medical damages such as past and future pain and suffering. An insurance company will not compensate a person for pain and suffering if the person cannot prove that they suffered a permanent injury. While the average person may be able to make the argument that their injury is permanent, a skilled injury attorney knows exactly what to look for when reading through a Plaintiff’s medical records in order to support the argument for permanency. This is a very important threshold which must be met in order to be successful in an auto accident injury claim.

Even if the insurance company for the defendant admits their driver was at fault, they may not admit that the accident actually caused your injuries. Though it may not seem necessary to hire a lawyer immediately after your rear-end auto accident, it is actually very important. Insurance companies are not in the business of paying claims and will utilize any reason to deny a claim.
