Miami Beach Bicycle Accident Settles for $50,000.00 policy limit

Our client, a 30 year old man, was riding his bicycle on Miami Beach when he was struck by a car that turned a corner without observing the stop sign. Our client was thrown to the ground and suffered injuries to his left shoulder and arm. He was transported by ambulance to the emergency room at Mount Sinai Medical Center where he was examined, treated and finally released.

Due to ongoing shoulder pain, our client came under the care of an orthopedic surgeon. He was diagnosed with a partial rotator cuff tear and opted for conservative treatment and therapy. After two months of therapy, his shoulder pain subsided and he was released from the doctor’s care.

Our client made a bodily injury claim against the insurance company for the car that ran the stop sign and caused this accident. His medical bills were paid by the same insurance company, as our client did not own a car, nor reside with a relative who owned a car registered in the state of Florida, which entitled him to the No-Fault Benefits of the car that hit him.

After review of the facts and circumstances regarding this accident, together with the medical documentation of our client’s injury, a demand for the $50,000.00 policy limit was made. The insurance company made a $35,000.00 initial offer which was rejected. 5 days later they tendered the $50,000.00 policy limit.
