Pedestrian Hit by Automobile While Walking Dog Recovers $200,000 Policy Limits

Our client was a 55 year old woman, walking her dog on the quiet residential street where she lived. An elderly woman turned the corner in her car and struck our client who was standing right next to the curb. Although our client did not sustain any fractures, she did suffer multiple orthopedic injuries. After several months of treatment and therapy, our client still had ongoing pain and sought treatment from an orthopedic surgeon. She ultimately underwent surgery to correct her thoracic outlet syndrome and made a fair recovery.
The defendant in this case carried a $100,000.00 bodily injury policy with Travelers Insurance Company. Travelers paid the $100,000.00 policy on demand. An underinsured motorist claim was then presented to The Hartford, our client’s UM carrier. The Hartford promptly surrendered the $100,000.00 UM benefit to compensate our client for her injuries, pain and suffering.
