Q: Can I ask my attorney for a copy of the settlement check?
A: Absolutely. You are entitled to full disclosure from your attorney and this includes proof that the case settled for the amount stated by your attorney. The attorney must also provide you with a copy of the settlement statement that outlines exactly how the money from the settlement will be distributed. This will include, but is not limited to, the amount of attorney’s fees, the court costs, the amount of medical bills, and any other expenses associated with your lawsuit.

Q: How do I collect my personal injury settlement?
A: If the settlement check is coming from an insurance company, the law firm will deposit the check into his trust account (after you have given the attorney permission to do so). Once the funds clear in the trust account the attorney will issue a check directly from his trust account to you. In limited instances if you are unable to receive a check, or perhaps live in another country at the time the case settles, law firms can often wire the money directly into an account for you for a small fee.

Q: In Florida, is there a minimum personal injury settlement amount?
A: Absolutely not. No such thing exists. Each case has a distinct value based on several variables, none of which are the same for any two people. Case value depends on the nature and extent of the injury, out of pocket damages, medical bills, pain and suffering, disabilities received, disfigurements to the body, lost wages, and numerous other factors. You might often hear on the radio or television that if you get into an accident you get a minimum of $10,000 in PIP benefits even if you are at fault in the accident. You can be rest assured that this advertisement is misleading. $10,000 in PIP benefits is not a $10,000 settlement. PIP benefits pay your medical bills and are paid from the insurance company directly to the doctor. These advertisements make people believe the money is for the client when in fact the doctor’s office wants to keep all the PIP benefits for yourself. If something sounds too good to be true… it often is.
