Weston Car Accident Victim Gets $100,000 from State Farm

Our client, a 40 year old construction worker was driving on I-75 in Weston, Florida on a rainy day. At that time, another driver was coming off the on ramp when he lost control of his car, hitting our client’s car. Upon impact, our client was forcibly thrown in and about his motor vehicle, thereby causing him to sustain serious injuries to his neck and back. The other driver, insured by State Farm Insurance Company, was cited for Careless Driving.

A few days later, because of increasing neck and back pain, our client was seen by an orthopedic surgeon. The doctor prescribed physical and chiropractic therapy, as well pain medication and a muscle relaxer. Our client also underwent a series of MRIs which revealed bulging discs in the neck and inflammation of the shoulder. The diagnosis was chronic impingement syndrome of the left shoulder. A determination was made that surgery would be required, and so our client underwent an arthroscopic decompression of the shoulder, with debridement of the rotator cuff. Despite the surgery, our client continued to have pain and limited range of motion in the shoulder.

In order to get compensation from State Farm, our client sought help from Weston car accident attorneys Dell & Schaefer. Do to the refusal of State Farm to settle the claim, Dell & Schaefer filed a lawsuit against the other driver. Once litigation was undertaken, our attorneys were able to convince State Farm of the necessity of settling the case, and a settlement was reached for the policy limits of $100,000. This amount went toward compensating our client for pain and suffering, medical expenses and lost wages.
