Winn-Dixie Pays Over $5k in Pompano Beach Slip and Fall Case


A 42-year-old Pompano Beach woman found out the hard way just how painful slip and fall injuries can be. The victim was shopping at a Pompano Beach Winn-Dixie when the slip and fall occurred. She slipped in a puddle on the store’s floor and fell without being able to catch herself. Emergency responders rushed her to a local hospital where doctors diagnosed her with serious neck, back and wrist injuries.

Physical therapy was not enough to alleviate the victim’s pain, so doctors had no choice but to perform a spinal fusion. As you might guess, her hospital and surgical bills were extremely expensive. In addition, there was the cost of physical therapy and pain medications. Despite her personal injury lawyer’s attempts at settling the case, Winn-Dixie would not agree to a just amount for the victim’s injuries.

At trial, evidence showed that Winn-Dixie knew about the puddle on its floor but did not clean it up. The judge also agreed that the victim did not suffer from any pre-existing injuries before her slip and fall accident. Despite Winn-Dixie’s attempts to discredit the plaintiff, the court ruled that the store was responsible and owed the woman over $5,000.

I too fell at Winn Dixie after an exmployee requested a puddle clean up and it was not done. I injured my right knee, however, did not go to MD, and still having issues 6 weeks later. I am a nurse and healing my own knee. Missed 5 days of work and sent Winn Dixie a demand letter. If they do not respond within the 30 days, per my demand letter, will need a lawyer. I don’t know if I have a case since I did not seek formal medical treatment.

I fell in Winn Dixie on 12/14/13 in a puddle of water that I didm’t see because the floors were so dirty. I saw the water afterwards when I got up. There were no signs placed in the area. I had my daughter as a witness and the guy who worked in the meat department, he was the one who came and cleaned the water off of the floor. I twisted the left side of my body when I went down (my ankle, knee, and my back). Also when I tried to break the fall with my right hand I sprained my wrist. The impact was so hard that I broke the handle on the basket with the items in it. My daughter ended carrying the basket to the register because my wrist was hurting at the time. I didn’t go right away to the Dr. because I work in the medical field so I was putting ice packs and ointments on. After about two weeks I could’nt take it anymore and had to go to the emergency room. I work 12hr nights and it’s getting to the point where I can’t stay on my feet because my knee is causing me pain and so is my wrist because I do alot of lifting of patients on my job.
