Our Client Is Working At The Bank When A Car Drives Through The Front Door

Our client, a twenty four year old woman, was working as a bank teller at a local bank in Deerfield Beach, Florida. The bank had installed a bullet proof window that shielded the bank tellers from any danger in the bank lobby. As our client was completing a transaction for a customer, suddenly and without warning an old man lost control of his car and drove the car through the bank’s front door and into the bank lobby. One unfortunate bystander was struck by the vehicle and suffered broken bones and other severe bodily injuries. Another bystander suffered herniated discs in his spine and other bodily injuries that were not life threatening. Our client however, was behind bullet proof glass and had no real threat of any physical harm to her body. However the accident upset her and she was forced to go home for the day. Not knowing what to do, our client called the Deerfield Beach Automobile Accident Attorneys Dell & Schaefer. Our firm quickly took the case and began the process of vigorously defending her rights under the law.

Our Client Undergoes Psychological Counseling

Our client suffered no physical bodily injuries. Nevertheless the accident made her feel a little sad and upset. In order to deal with these feelings, she went to a psychological counselor four times to discuss her emotional distress related to the accident. After the four visits with the counselor were over, the counselor cleared our client to return to work.

Dell & Schaefer Negotiate A Settlement

Immediately after the psychological counseling sessions were over our client filed a bodily injury demand against Nationwide Insurance Company. Nationwide Insurance company only had a 25/50 policy which means the most one person could receive was $25,000 but the maximum the policy would pay out was $50,000 no matter how many claimants there are. In this case Nationwide had already tendered out $25,000 to one of the victims who suffered broken bones. That only left $25,000 remaining between two claimants… our client and the other victim who suffered herniated discs in his back.

Normally herniated disc cases can have a value of over $25,000. Nationwide Insurance Company stated their intent to pay out the remaining $25,000 to the herniated disc victim which would have left nothing for our client. Our firm refused to sit back and allow our client to get the short end of the stick. We immediately filed a lawsuit but did not serve it on Nationwide Insurance Company’s client. Rather we sent them a courtesy copy of the complaint and we also sent a courtesy copy of the complaint to the attorney who represented the herniated disc victim. We demanded to split the remaining $25,000 with our client or else we would file for an immediately injunction in court to halt the negotiation proceedings and demand a speedy trial to determine who is entitled to the remaining $25,000. The attorney for the herniated disc victim obviously got concerned he could lose the case so he agreed to split the remaining $25,000 equally. Our client received $12,500 and the herniated disc victim received $12,500. Even the representative from Nationwide Insurance was shocked our firm was able to recover as much money as we did for our client without any physical bodily injuries. Our client was absolutely thrilled that our firm went the extra mile. She stated that she had called hundreds of law firms who refused to take the case because there was no physical bodily injury. But our firm never waivers in our resolve to get the best results for each client, regardless of what injuries they sustain. If they sustain an injury, physical or mental, our firm will be there to help.
