Tourist slipped and fell in large Miami department store on spilled hand sanitizer, requiring wrist surgery; Attorneys Dell and Schaefer recover $75,000


Our client, a 57 year old tourist, was in a large retail store in Miami, when he slipped and fell on hand sanitizer which had dripped onto the floor. In an attempt to brace his fall, he put out his arm, resulting in a fractured wrist. He was seen by an orthopedic surgeon specializing in hand and wrist surgery, who performed surgery on our client in which a plate and screws were placed in the wrist.

The retailer refused to make a significant offer to settle the claim. The retailer first denied any liability, but luckily our client’s son was alert enough to take a photo of the hand sanitizer on the floor. The store’s attorney also claimed that the store was not on notice of the spill; however, we were able to show that there were store employees in the area and that they should have been able to detect and clean up the hand sanitizer. After lengthy discovery, we were able to settle the claim for $75,000 on behalf of our client.
