$110,000 Maximum Recovery Obtained by Hollywood Car Accident Attorney

Hollywood Boulevard in Hollywood, Florida is not known for being a celebrity hotspot, but it is clearly the location of the majority of car accidents in Hollywood. An auto accident on Hollywood Blvd is a daily occurrence.

For our 28 year old client, he never expected that a driver would carelessly rear-end his vehicle while he was stopped at a red light near Presidential Circle. As Hollywood car accident attorneys, we have helped auto accident victims on a daily basis for more than 30 years. This particular client not only suffered serious injuries, but he we also given the run around by the auto insurance companies responsible for handling the aftermath of his car accident.

Insurance Company Initially Refuses to Pay Medical Bills Following Hollywood Car Accident

Our client in this case failed to change his address and his car insurance company denied his claim for $10,000 in personal injury protection (PIP) benefits to pay for his medical bills. Florida law requires policy holders to change their addresses after moving from one address to another. The auto accident lawyers of Attorneys Dell and Schaefer appealed the denial arguing that our client still retained sufficient contacts with his former address to qualify him as “residing” at the old address.

After winning the appeal our client received $10,000 in PIP benefits paid out for his medical bills. This allowed our client to see several doctors and have the majority of his bills covered by the auto insurance company. We next focused on obtaining compensation for our client’s injuries sustained in the accident.

Back Surgery Required Following a Rear-End Collision in Hollywood

Our client, a 28 year old student, was on his way to his school when he was involved in a serious care accident. As he reached the Presidential Circle, the car directly behind him failed to see him stopped for a red light. As a result, the car directly behind him slammed into the rear of our client’s vehicle at a high rate of speed causing heavy damage to the structure and frame of both cars. Our client immediately felt pain in his lower back.

He immediately sought the care and medical attention of a local Hollywood chiropractor. The chiropractor examined and diagnosed him with sprain/strain of the lower back. The doctor recommended an intense physical therapy regimen. After 2 weeks without improvement, he was given a prescription for an MRI. The MRI showed a herniation in his lumbar spine at L5-S1. As a result of the significant MRI findings, the client was referred to an orthopedist. The orthopedist recommended a one level lumbar discectomy surgery to repair the herniated disc.

The client was scared to undergo the surgery, but he could no longer manage the pain. The client was advised by his injury attorney that the cost of the surgery and any time lost from work would be paid for as part of his total recovery. He underwent the surgery and within weeks after the surgery our client informed us that he made a 100% pain free recovery. The ability to be pain free was more important to him than any amount of money he could recover.

We were determined to obtain a maximum recovery for our client as he had been suffering for several months and had been through a lot as result of the car accident.

Attorneys Dell and Schaefer Seek Maximum Recovery of $110,000 for Our Client

The person that crashed into our client was insured by USAA and they had $100,000 of total insurance. Our client also had $10,000 of underinsured motorist car insurance. Following several months of medical treatment and his surgery our Hollywood personal injury attorney submitted a demand to USAA for monetary damages including pain and suffering, lost wages, bodily injury, and medical bills for the past and future.

USAA initially attempted to argue that the injuries were not caused by the accident and even if they were it was not necessary to have surgery. We advised USAA that they had 30 days to tender the $100,000 policy limits or a lawsuit would be filed immediately. After a lengthy negotiation process, the $100,000 was tendered and our client was extremely pleased.

In addition, our client had uninsured motorist benefits with his own insurance company in the amount of $10,000 which our firm successfully recovered as well. The total gross recovery was $110,000, which was the maximum amount that could have possible been recovered.

Our client was especially glad that we were able to resolve this claim in a quick manner without the need to file a lawsuit. If you have been injured in an accident, then call us for a free consultation to discuss your options.
