After Commercial Truck Accident In Miami, Dell & Schaefer Files Lawsuit On Behalf Of Client


Our client was driving his vehicle northbound on LeJeune Road in Miami, Florida and stopped for a red light. A commercial truck that was delivering large metal poles stopped along the left side our client’s vehicle. The left turn only arrow changed to green for the commercial truck.

As the commercial truck attempted to make the turn, the large metal poles that were protruding out the back of the truck struck our client’s vehicle, the force from which nearly flipped our client’s vehicle onto its side. The metal poles shredded the entire left side of our client’s vehicle which caused it to lift off the ground and then slam back down against the pavement.

As a result of the accident, our client suffered severe injuries to his neck and back and began treatment with an orthopedic surgeon. A cervical MRI revealed a herniated disc with impingement. As a result, our client’s orthopedic surgeon has recommended a cervical fusion if conservative treatment is unsuccessful.

After realizing that the law firm he originally hired was unable to fight for his rights, and that he had made a possible million dollar mistake, he terminated the representation and hired Attorneys Dell and Schaefer, who immediately filed a lawsuit against the insurance company for the commercial trucking company, which contained policy limits of $5,000,000.00 (five million dollars).

The lawsuit is still pending in the Federal Court for the Southern District of Florida.
