Miami Negligent Security Attorney Recovers $175,000 For Injured Victim Following Robbery

Client, a 47 year old electrician, stopped at a busy 24 hour gas station/convenience store at 1:00 am on a Friday night. After he pumped his gas, he was walking toward the store when he was the victim of a strong armed robbery on the sidewalk immediately in front of the entrance doors.

Client suffered a laceration to his head and a fractured cheek bone subsequent to being hit with the butt of a pistol. Client incurred a $25,000.00 medical bill and a $3,000.00 wage loss as a result of his injuries.

Personal Injury Attorneys Dell & Schaefer, filed a negligent security lawsuit against the owners of the store, alleging that they had actual knowledge of recent strong armed robberies and took no action to protect their customers.

An investigation revealed that 3 recent robberies occurred on the premises and that the lighting in the area frequented by customers was very poor.

After the lawsuit, the store owner significantly upgraded the lighting on the premises and hired a security guard to patrol the parking lot and store from 11 p.m. to 6 a.m. daily. Since the proper security and lighting measures were instituted there has not been a strong armed robbery on the premises.

In the instant case, the client made a good recovery from his injuries and was left with a small permanent frail scar. The case settled for $175,000.00.
