Victim Rear Ended In An Automobile Accident

Our client, a middle aged man, was driving his vehicle in Palatka, Florida. Our client was stopped at a traffic light at the corner of Mosely Ave and St. Johns Ave. Suddenly and without warning another car smashed into the rear of our client’s vehicle. The impact was so great that our client’s vehicle spun 360 degrees and then launched up onto the curb and onto a neighbor’s lawn. Our client was dazed and confused for a few minutes but otherwise did not suffer any serious bodily injury. Our client did feel some pain in his neck and back. He called the Palatka Auto Accident Attorneys Dell and Schaefer. Our firm quickly sent a private investigator to his house to sign the necessary paperwork and retain us to represent him for his injuries.

Our Client Undergoes Therapy With A Local Chiropractor

Within a week after the accident, our client sought the care and medical treatment of a local chiropractor. The chiropractor examined our client and diagnosed him with extreme whiplash and neck sprain/strain. He recommended an intense physical therapy regimen. Our client underwent the therapy. After the therapy was done our client felt 90% better. He sought the care and medical attention of a local orthopedic surgeon. The surgeon recommended that our client undergo surgery. However our client was very afraid of surgery and decided not to undergo the procedure.

Dell and Schaefer Negotiates A Settlement

After the treatment was over, our firm filed a bodily injury demand letter with the tortfeasor’s insurance company. Our firm sought monetary damages for bodily injury, aggravation of a preexisting injury, pain and suffering, loss of consortium, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy negotiation process, our firm resolved the case for $40,000. It is important to note that soft tissue cases in Florida typically resolve somewhere between $7,000 and $20,000 depending on the type of injury, amount of property damage, and the insurance company. This case resolved for twice as much as the average settlement with similar circumstances. Our client was absolutely thrilled that we were able to get him such a high settlement. Due to the high settlement, the insurance company put a confidentiality clause prohibiting our firm from disclosing the name of the insurance company to the public.
