Client Gets Into A Bad Car Accident

Our client, a mid-thirties young woman, was driving her car in Florida City, Florida. Suddenly and without warning, another vehicle ran a stop sign and struck our client’s vehicle on the passenger door side. The impact was so great that our client’s car swerved into oncoming traffic and then stopped on the grass on the opposite side of the street. Fortunately there were no cars approaching in the oncoming traffic or else our client could have lost her life. Immediately after the accident, our client felt pain in her neck and back. Not knowing what to do, she called the Florida City Automobile Accident Attorneys Dell & Schaefer. Our firm sent one of our attorneys to the client’s house to sign up the case.

Client Undergoes Treatment

Within a day or two after the accident, our client sought the care and medical attention of a local chiropractor located in Homestead, Florida. The chiropractic physician diagnosed our client with a sprain strain to the neck and back. He recommended our client undergo an MRI. The MRI showed two disc herniations in her neck and three disc herniations in her lower back. Because the MRI showed positive findings, our client was referred to an orthopedic surgeon. The orthopedic surgeon diagnosed our client with traumatic injury to her neck and spine. He recommended surgery to repair the herniations. Although surgery was advised, our client declined to undergo the procedure out of fear of anesthesia and surgery.

Dell & Schaefer Negotiate A Settlement

After the treatment was done, our firm filed a bodily injury demand against the insurance company for the tortfeasor. Our firm sought monetary damages for bodily injury, aggravation of a preexisting condition, pain and suffering, loss of consortium, disfigurement, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy negotiation, our firm settled the case for the policy limits. Our client was thrilled that our firm was able to get the policy limits despite her refusal to undergo surgery.
