Boca Raton Car Accident victim receives $55,000.00 settlement for shoulder injury
A 63 year old Boca Raton, Florida retiree was injured when the large conversion van he was driving was rear-ended by a Geico policyholder driving a Toyota sedan. Though the external damage to the van was not extensive, the force of the impact was so great that it caused several components of the van’s interior to become damaged.
Our client immediately complained of left shoulder pain as a result of the accident. He immediately began conservative treatment and physiotherapy but noticed that his painful shoulder symptoms were not improving. An MRI of his left shoulder was taken which revealed a tear to the left rotator cuff as well as a Grade II AC ligament sprain. Our client was administered cortisone, xylocaine and marcain injections in his shoulder in an effort to alleviate his symptoms. Unfortunately, these efforts did not resolve his symptoms of pain. The treating doctor determined that the only remaining course of medical treatment available to our client was a surgical arthroscopy of the left shoulder with arthroscopic capsulotomy, synovectomy and manipulation under anesthesia. Our client underwent these procedures and reported that his symptoms of pain had been nearly eliminated within the month following the procedures.
The personal injury attorneys from the Law Office of Dell and Schaefer demanded the $50,000.00 policy limits from Geico and the $25,000.00 Uninsured/Underinsured policy limits from Florida Farm Bureau. Geico initially denied the claim and argued that the shoulder injury could not have been the result of this accident due to the fact that our client was rear-ended and not struck from behind.
Florida Farm Bureau agreed to tender the $25,000.00 policy limits even though Geico was refusing to make an offer. The personal injury lawyers from Dell and Schaefer prepared to file suit against the Geico policy-holder but were able to settle with Geico right prior to the filing of the lawsuit.
Our client was very happy with the outcome as he was able to get the medical attention he needed, helping to resolve his painful symptoms. He was also happy with the compensation he received as a result of this settlement.
