Defendant Cuts Off Our Client Causing A Collision
Our client, a retired refugee from Cuba, was driving his vehicle back home to Miami, Florida. He had stopped in Arcadia, Florida to visit a family friend and had just started on his trek back home. When he reached the corner of N. Desoto Ave and W. Hickory Street the defendant ran a red light and T-boned our client on the driver side. The impact was not that powerful and only resulted in minor damage to the driver side of the car. Our client did suffer minor neck and back injuries.
Client Begins Physical Therapy
Our client drove his vehicle back to Miami, Florida. Upon his return, he called the Arcadia Automobile Accident Attorneys Dell and Schaefer. Immediately after hiring our firm, our client began a course of conservative physical therapy with a local chiropractor. The doctor diagnosed our client with minor sprain/strain to his neck and back and prescribed 12 weeks of physical therapy and an MRI. The MRI showed a broad based herniation to the cervical spine. Fortunately, his injuries did not require surgical intervention nor injection therapy.
Dell and Schaefer File A Claim With Scottsdale Insurance Company
After the therapy was over, our firm filed a bodily injury demand with Scottsdale Insurance Company. Our firm sought monetary damages for bodily injury, aggravation of a preexisting condition, pain and suffering, loss of consortium, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages (although retired, our client still worked part time). After a lengthy negotiation process, the case settled for $100,000. Our client could not believe that a minor fender bender could result in such a high settlement. When it was time to bring the check he brought three members of his family to meet our staff and to personally thank us and introduce us to his closest relatives. We were delighted that he took the extra effort to introduce us to his immediate family.
