Client Is Struck From Behind Causing Her To Strike The Vehicle In Front

Our client, a 60 year old woman, was hit from behind while stopped at a red light. Although the defendant denies it, the only justifiable explanation was the driver was texting or surfing the internet while driving. The impact was so great, our client was then pushed into the vehicle in front. As a result, our client suffered two impacts, one that caused our client’s neck to jolt backwards, and then a second one causing our client’s neck to jolt forwards. Immediately after the accident, our client blacked out for approximately 5-10 seconds. When she regained consciousness, she saw smoke coming from her front hood and heard hissing sounds coming from the back. Scared for her life, she ripped off her seatbelt and ran from the vehicle. Not knowing what to do, she called the Miami Automobile Accident Attorneys Dell and Schaefer.

Client Undergoes Surgery

Our client was in severe pain since the accident. Chiropractic care failed to give her any relief, and the orthopedic surgeon said surgery was the best way to resolve the problem. The orthopedic surgeon diagnosed our client with a herniated nucleus pulposus at C4-C5. The orthopedic surgeon performed a discectomy at the C4-C5 cervical leval.

Dell and Schaefer Negotiate A Settlement

After the surgery our firm filed a bodily injury demand against Esurance. Our firm sought monetary compensation for bodily injury, aggravation of a preexisting condition, pain and suffering, loss of consortium, disfigurement, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a quick negotiation, Esurance tendered the policy limits of $100,000.
