Client Slips And Falls In A Supermarket
Author: Attorney Daniel Villalobos
Our client, a retired woman who spends her life going to church, praising Jesus, and following the laws of the Lord, was in a local supermarket chain buying groceries for herself. As she neared the chicken wing section, suddenly and without warning she fell on some type of black liquid substance that had leaked from a nearby soda fountain. Most likely some not too bright customer filled a soda cup too much with Coca Cola and let it drip from his or her cup while he or she walked away. Regardless, our client did not have any fault in this slip and fall situation. After she fell, she blacked out and had to be helped up by nearby patrons. The supermarket also called the paramedics who came and took the client to the hospital. Not knowing what to do, she looked into the yellow pages at the hospital and called the Miramar Slip and Fall Attorneys Dell and Schaefer. Our firm quickly took the case and began the process of zealously representing her interests.
Client Undergoes Surgery
After the fall, our client underwent a course of physical therapy with a local and friendly chiropractor. After conservative treatment failed to give our client any long term relief, she was referred out for an MRI. The MRI showed multi level herniations in her spine as well as a tear in her knee. Knowing that therapy would not heal a knee, she knew she only had one choice—surgery. Our client scheduled and underwent the procedure.
Dell and Schaefer Negotiate A Settlement
When the surgery was over, our firm filed a bodily injury demand against the supermarket. Our firm sought monetary compensation for bodily injury, pain and suffering, aggravation of a preexisting condition, loss of consortium, disfigurement, disability, and mental anguish. After a lengthy negotiation failed to generate a high enough offer, our firm was forced to seek pre-suit mediation. During pre-suit mediation, the opening offer was only $25,000. After about 4 hours of negotiations and counter offers the case finally settled for $90,000. Our client was ecstatic that our firm was able to get an increase of over 200% of the original offer.
