Dell & Schaefer obtain settlement of $292,500 from pharmacy
Hollywood woman trips over concealed rebar in pharmacy parking lot
Our client, a 46-year-old woman living in Hollywood, Florida, was walking to her neighborhood pharmacy. She entered the pharmacy premises by walking through the bushes. In the pathway which had been worn between the bushes was a bent rebar sticking out of the ground. Our client tripped over the rebar, falling and injuring her back. The following day she went to the emergency room, and later followed up with a chiropractor. After her problems continued, she underwent an MRI which showed a herniated disc in her lower back at the L4-5 level. She was referred to an orthopedic surgeon, and ultimately she underwent a fusion in which metal plates and screws were placed in her back. Despite the surgery, she continues to suffer from ongoing back pain.
Attorneys Dell & Schaefer sue the pharmacy and landscaper
Having incurred extensive medical bills and endured pain and suffering, our client sought the help of Hollywood accident attorneys Dell & Schaefer. After investigating the claim it was determined that both the pharmacy and their landscaper had responsibility for the accident. A lawsuit was filed and many depositions were taken. The defendants claimed that our client was at fault for the accident, and that she had extensive pre-existing back complaints.
Dell and Schaefer Obtains $292,500 for our client
The defendants were unwilling to adequately pay for what our client had been through, so we pushed them to the eve of trial, at which time they decided that going to trial would very likely result in a negative verdict for them. At that time we were able to work out a settlement for our client for $292,500. Fortunately, despite having many hundreds of thousands of dollars in medical expenses, we were able to negotiate with the medical providers in order to put a substantial portion of the settlement in our client’s pocket.
