Florida Power and Light – Responsibility to Maintain Property

Florida Power and Light, or FPL, has property and equipment in many areas all over the State of Florida. It would seem like an overwhelming task to maintain and insure that all of this equipment is in safe operating order. FPL has an absolute responsibility to maintain its own property, failure to do so could cause serious harm, notwithstanding the apparent daunting task of maintenance.

Our client was at home, in their bedroom when a piece of FPL equipment came flying through their window. The piece of equipment was a broken and rusted lock from an FPL electrical box. The lock was propelled through her window because it was driven over by a lawn mower. The lock shattered the window causing glass to be disbursed throughout the bedroom. As a result of the flying glass, our client was cut in several locations.

FPL had a legal responsibility to maintain its equipment, which it failed to do. As a result of their failure to maintain its equipment a customer was injured. It was only through sheer luck that the consequences of this particular failure to maintain property weren’t greater.
