Guest At Wyndham Vacation Resort Suffers Severe Back Injury From Slip And Fall Due To Dangerous Condition


Our client, a 35 year old professional man brought his wife and children to Florida for a vacation at Disney World. He made arrangements for his family to stay at Wyndham’s Bonnet Creek Resort in Lake Buena Vista, Florida.

Late one afternoon, our client was walking down a carpeted hallway to his guest room when he suddenly and unexpectedly fell when several pieces of the carpet tile slid out from underneath him. This caused his feet to come out from under him before landing hard on his back. Immediately following the fall his shorts and socks were covered with the green wet glue that was on the cement floor after the carpet tile slid away.

Immediately after the fall our client was suffering with severe pain in his back and wrist. Fire rescue was called to the scene and transported our client to Florida Hospital Celebration where he was x-rayed, treated and finally released several hours later.

Upon returning from vacation to his home state, our client began a course of treatment and therapy to treat the injuries he sustained to his back, wrists and shoulder. After a short course of therapy, our client was prescribed a Lumbar MRI as his condition was not improving. The lumbar spine MRI revealed a central disk herniation at L5-S1 with compression on both LS nerve roots. After several months of treatment and therapy, our client continues to suffer from back pain and the severe limitations it places on him.

Wyndham Vacation Ownership, Inc. Receives Legal Demand Letter And Waits More Than 50 Days To Respond.

Shortly after the accident, the client hired Attorneys Dell & Schaefer to help him obtain compensation for his medical bills, lost wages, and pain and suffering. After several months of receiving medical treatment, our firm sent an extensive demand package with medical bills and additional information to Wyndham. Resort: Kauai Beach Villas, in Lihue, HI.

On April 10, 2015 around 9:30 am. I was leaving the welcome seminar right by the resorts main office and i tripped on a raised (2-3″ high) corner of the slab exiting the seminar. I was transported to the emergency room and had a ct scan of my head. I had tripped on landed on my face. It took more than 5 minutes to get my nose to stop bleeding. I have pictures of the injuries done to my face. This includes: broken glasses, cracked tooth, swelling, pain, headaches, black and blue marks which lasted the entire time of my vacation and I still have pain in my nose. The ER doctor told me to consult a nose specialist when the swelling goes down. They took pictures of the incident and fixed the area immediately. I have only been given a case number saying that there was an incident and the number of the case and told that an claims adjuster would contact me. They would not give me the number of the claims department or the write up of the incident. I have not received any kind of contact from them. Is this something that I should pursue?

They took pictures but I was sent to the ER by ambulance so I was unable to take a picture. My sister was with me and there were a lot of people from the welcome seminar who saw it. They repaired the corner immediately. I have one picture of it repaired and you can see how the repair was on the corner and not the entire sidewalk. I do have pictures of the damage done to me.

Hi last year my daughter and I were visiting a wyndham resort where I am owner. We both tripped and fell in a rug as we were entering the premises. No one but my family at the resort came to help. My baby was hysterical and I landed on my knees carrying her and as we fell she hit her head. On 6/5/18 I slipped and fell by my lounge chair near the pool. I was barefoot and my feet were completely dry . There was obviously something from a previous guest that was never cleaned up … Either tanning oil or liquid of some sort to fall that hard. I cracked my knee completely across. Security heard me crying and saw me limping back to my room. There was a claim filed and they refused to cover ANYTHING… not even the medical bills I’m now stuck with. It’s Ludacris. I hope I can get help. My mom has been an owner for nearly 10 yrs and is disgusted by the way I have treated.
