Injured Driver settles case for $90,000.00

Our client is a 40 year old man who was involved in an auto accident with a drunk driver. He was sitting in his car in front of his house when a car travelling at a high rate of speed turned the corner and crashed into the driver’s side of my client’s vehicle. Following the accident, the driver of the at-fault vehicle was arrested and charged with driving under the influence of drugs/alcohol.
Our client was taken by ambulance to the emergency room at Memorial Hospital where he was treated for neck and back pain, before being released. He followed up with an orthopedic surgeon and was prescribed 3 months of physical therapy. Although his overall condition improved, our client’s neck pain persisted. The orthopedic surgeon prescribed a series of injections in an attempt to alleviate our client’s neck pain. Over a period of 3 months, our client received 3 injections in his neck, which relieved his pain substantially.
After several months of treatment and therapy, the orthopedic surgeon released our client from care and determined that he had sustained a 9% partial disability as a result of the injuries he sustained in this accident. The case was prepared and submitted to the insurance carrier that provided coverage to the drunk driver. An initial offer of $60,000.00 was made within 30 days and immediately rejected by our client. After a short course of negotiations, the case settled for $90,000.00.
