Key West contractor falls due to broken stairs, injures low back


Our client, a 42 year old contractor, was performing work at the Ron Jon store in Key West. He was walking down the exterior stairs on the side of the building when a stair broke loose, causing him to fall. He landed on his backside causing him to sustain an injury to his low back. The staircase had rotted wood and needed to be replaced.

Shortly after the accident our client sought medical attention, and a few days later went to the emergency room at Lower Keys Medical Center due to the severe back pain. He ultimately saw an orthopedic surgeon who performed a fusion at the SI joint at the base of his spine. Luckily, the surgery was successful and provided our client with a great deal of relief from the pain.

In an effort to obtain compensation for his injuries, our client hired Attorneys Dell & Schaefer to represent him against the owner of the building and the tenant, Ron Jon. The defendants denied our clients allegations, requiring our litigation department to file a lawsuit in Monroe County on behalf of our client. Numerous depositions were taken which developed the full picture of the dangerous nature of the staircase.

Lengthy negotiations ensued, but ultimately, upon proof of the dangerous condition of the stairs, we were able to resolve the claim for $215,000.
