Our Client Engages A Punching Bag Machine
Our client, a mid-thirties man, entered into a bowling alley with his friends for a night of fun. During the event, our client and some friends decided to play the “bag punching” game whereby a punching bag drops down from the top of the machine and the player punches the machine as hard as possible in order to get the highest score possible. Our client put the dollar bill in the machine, pressed the big red button releasing the punching bag from the top. Our client stepped back a few feet and got a nice running start to get the best punch possible. He drilled the punching bag machine with all his weight and power. However after his fist punched through the punching bag his arm and fist swung around and accidentally struck the change machine which was negligently placed immediately adjacent to the punching bag machine. After the treatment was over our firm filed a bodily injury demand against the insurance company of the bowling alley. Our firm argued that the bowling alley was responsible for our client’s injuries because it was negligent of the bowling alley to put a change machine right next to a punching bag machine when they knew or should have known that doing this created an unreasonable danger of injury to unsuspecting players of the punching bag machine. Our firm sought monetary compensation for bodily injury, pain and suffering, loss of consortium, disability, disfigurement, aggravation of a preexisting injury, mental anguish, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy negotiation the case resolved for $16,000.
