Our Client is Struck While Riding His Bicycle

Our client, a middle aged man from Hialeah, Florida, was riding his bicycle on the side of the road. As he approached a driveway, suddenly and without warning, a vehicle exited the driveway and entered the roadway without making a proper lookout for pedestrians and bicyclists. Our client could not stop in time and struck the side of the car. The impact caused our client to smack his head against the side of the car, fall off his bicycle, and land on the ground. Fortunately our client was wearing a helmet and did not suffer any brain injuries. Our client did however have pain in his neck, back, wrists, knees, and ankles as a result of the accident. Not knowing what else to do, our client called the Hialeah Bicycle and Automobile Accident Attorneys Dell and Schaefer for help. Our firm quickly signed up the case and began the process of zealously representing our client’s interests.

Our Client Undergoes Medical Care

The same day as the accident, our client was unable to move from his bed. He had aches and pains all over his body, headaches, and sore muscles. Bicycle accidents often cause much more severe injuries than an automobile accident. Our client sought medical care and rehabilitation from a local chiropractor. The chiropractor diagnosed our client with contusions and multiple sprain/strains all over the body. He prescribed an intense physical therapy regimen. After weeks of treatment without relief from pain, our client underwent several MRIs. Fortunately most of the MRI’s were normal, however the cervical and lumbar MRI’s showed multi-level herniations up and down our client’s spine. As a result of positive findings on the MRIs, our client was referred to an orthopedic surgeon. The orthopedic surgeon recommended surgery and epidural injections for pain. Since our client was terrified of surgery, he opted to undergo epidural injections in his cervical and lumbar spine.

Dell and Schaefer Negotiate A Settlement

After the treatment was done, our firm filed a bodily injury claim with the insurance company. Our firm sought monetary damages for bodily injury, pain and suffering, aggravation of a preexisting injury, loss of consortium, disfigurement, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy settlement negotiation, our firm resolved the case for $115,000.
