32 year-old Melbourne mechanic settles case after being run off the road twice
A 32 year-old Melbourne, Florida mechanic was injured when his vehicle was run off the road for the second time within two years. Our client is a mechanic who works in an industrial section of an incorporated part of Brevard County. He takes Malabar road to and from work every day and has always complained that this road is dangerous because of the amount of big trucks that traverse the road each day. Early one morning on a hot summer day, he was on his way to work when he was run off the road by an 18-wheeler. He noticed the truck coming up fast in his rear-view mirror and before he knew it, the truck was passing him on his left-hand side. The truck then quickly came into his lane and ran his vehicle off to the right of the road, causing his vehicle to drive into a ditch. Some of his work tools, which were in the back seat of his vehicle, struck him in the head upon impact, causing him to lose consciousness. Luckily, another driver saw the entire incident and called 911 to report the accident. This was the second time within two years that he was run off the road by another vehicle.
Melbourne, Florida mechanic is rushed to the hospital
Several minutes later, an ambulance arrived on the scene. Emergency technicians were able to revive our client, place him on a backboard, and rush him to the hospital. The emergency room physician at the hospital ordered a CT scan of our client’s brain to rule out any brain damage. Luckily, the scan was negative for brain injury but doctors determined that he suffered a concussion in the accident. He also broke his nose in the accident which resulted in a severely deviated septum. He was discharged from the hospital and instructed to seek follow-up care. He was referred to a board certified orthopedist and a neurologist. He was recommended for surgery to correct the deviated septum, which he quickly scheduled. His orthopedist prescribed an MRI of his back in order to rule our spinal damage.
Melbourne auto accident victim hires the Law Office of Dell and Schaefer
Because he was getting nowhere with his own insurance company, our client felt it was necessary to consult a lawyer. He made an appointment with the attorneys at the Law Office of Dell and Schaefer and hired our firm that same day. The driver who ran our client off the road was never identified. The only way to get our client compensated was to make a claim against his uninsured/underinsured motorist (UM) coverage. Luckily, our client purchased UM when he bought his automobile insurance policy. He would soon find out that purchasing this coverage was a very good decision. Our lawyers were able to make a claim against his UM coverage in an effort to get him compensated.
Melbourne accident victim has nasal surgery
Because he could not breathe very well after the accident, our client couldn’t wait to have surgery to correct his deviated septum. The surgery went very well for him and he reported that the surgery gave him a great relief. Luckily his spine was not injured as a result of the accident and even though he suffered a concussion, he was not having severe symptoms. Our lawyers demanded compensation for his injuries. The insurance company was not quick to offer compensation. They argued that because this was the second time he was run off the road, our client must be acting fraudulently. They could not believe that someone could coincidentally be involved in the same type of accident twice.
