Miami Beach Auto Accident Settles for $325,000.00!
Our client, a forty year old man and father of two, was driving to work in Miami Beach. He was stopped at a traffic light near Collins Ave and 17th Street, when the car directly behind him rear ended his vehicle at a high rate of speed. The impact was so great that our client hit the car in front of him. Our client immediately felt pain in his lower back, which grew worse as time progressed. Our client sought the care and medical attention from a chiropractic physician for the pain in his back.
After a physical examination, the physician diagnosed our client with a strain to his lumbar spine. The doctor prescribed an intense physical therapy regimen. After two months our client did not feel any long term relief from the pain in his back. Certain days the pain would subside and other days the pain would return.
The chiropractor then prescribed our client to undergo a MRI of his lumbar spine. The MRI revealed a herniated disc at L3-L4 with impingement on the spinal cord. As our client was not getting long term relief with conservative chiropractic care, he was referred to an orthopedic surgeon for an evaluation.
The orthopedic surgeon examined our client and diagnosed him with a lumbar disc herniation. The doctor recommended that our client undergo a one level lumbar fusion at L3-L4. After the surgery, our client returned to physical therapy for two months. Fortunately, our client had health insurance and was able to undergo the procedure without having to pay any out of pocket expenses.
Due to the severity of his injuries, our client retained the Miami Beach Auto Accident Attorneys, Dell and Schaefer to represent him for his damages against the insurance company. Dell and Schaefer presented a claim for outstanding medical bills, pain and suffering, and three months of lost wages. The insurance company only offered $100,000.00.
Believing that the case was worth substantially more, our firm filed a lawsuit in the Circuit Court of Miami-Dade County. Depositions were taken and after the discovery process was completed, the case was noticed for trial. Prior to trial, a court ordered mediation was scheduled, and the case settled for $325,000.00!
