Client Falls In Sedano’s Supermarket
Our client, a middle aged woman who immigrated from Cuba, was walking in her favorite supermarket—Sedano’s. Suddenly and without warning, she slipped and fell on spilled coffee beans. Normally fresh coffee from Colombia brings her a much needed jolt of energy to carry her through the day, however in this unfortunate incident, the fruit of her favorite drink brought her needless pain and suffering. After she fell, she realized a customer had dropped a can of fresh Coffee beans on the floor and the staff of Sedano’s never cleaned it up.
Fortunately she had her handy camera phone on her and after she was lifted off the ground by nearby customers, she took pictures of the coffee beans on the floor and also took pictures of the staff cleaning it up. This prevented the store from denying the existence of the dangerous condition on the floor.
Client Seeks Medical Care
After the fall, our client sought the care and medical attention of a local chiropractor. The chiropractic physician diagnosed her with contusion to the hip as well as sprain/strain to the neck and back. The chiropractor referred her out for an MRI. The MRI came back positive, showing multiple herniations in her cervical and lumbar spine. The orthopedic surgeon recommended surgery to repair the damage. The client decided to undergo the procedure.
Dell & Schaefer Negotiate A Settlement
After our client underwent surgery, our firm filed a bodily injury demand against the insurance company for Sedano’s. Our firm sought monetary compensation for bodily injury, aggravation of a preexisting condition, pain and suffering, loss of consortium, disability, disfigurement, mental anguish, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a very lengthy negotiation, the case resolved for $120,000.
