Client Has Back to Back Accidents

Our client, a young mid thirties man from Jamaica, lived in Miami Florida. One day in July, as he was driving his car suddenly and without warning, another vehicle struck him from behind as he was stopped at a traffic light. The impact was only minor, nevertheless our client felt pain in his neck. As he was a former client of our firm and pleased with the settlement of his first case over 7 years earlier, he once again called the Miami Automobile Accident Attorneys Dell and Schaefer. Our firm quickly took his case and began the process of zealously representing his interests. However, three weeks later in August, he was struck from behind yet again from another vehicle while stopped again at a traffic light. This time it was a super big accident with heavy property damages. Not knowing what to do he once again called the Miami Automobile Accident Attorneys Dell and Schaefer.

Client Begins Treatment

The injuries were the exact same in both accidents. Our client sought medical care from a local chiropractor. After an intense physical therapy regimen was completed, our firm sought help from a local orthopedic surgeon. The orthopedic surgeon recommended and did administer one set of injections to our client’s lower back for pain. The injections worked wonders and are client was fully healed from the accident.

Dell and Schaefer Negotiate A Settlement

After the treatment ended, our firm filed a bodily injury demand against both insurance companies. The insurance company for the first case in July tried to blame the second accident as the superseding cause of his injuries and tried to deny his claim. The insurance company for the second case in August tried to blame the first accident and tried to deny the claim. Our firm did not want to play games and we quickly put our money where our mouth was. We filed two lawsuits and began the process of serving the drivers of both accidents. This obviously worried the insurance companies who did not want to get wrapped up in multi defendant litigation for multiple dates of accidents, and both insurance companies ended up tendering out their policy limits.
