Orlando Driver Charged in Fatal Truck Accident
According to the News Observer, one passenger was killed on June 1 following a North Carolina truck accident involving a driver from Orlando. The accident occurred just after 4 a.m., when John Richard Clark, 47, collided with a tractor-trailer that lost control after running into a median.
The truck driver, Harold Feill, of Orlando, allegedly fell asleep at the wheel before striking the median. Feill was treated at a nearby hospital for injuries and Clark was pronounced dead at the scene.
Investigators will likely subpoena the drivers hours of service log to ensure that it is in full compliance with federal regulations. According to Federal Motor Carrier Safety Administration (FMCSA) laws, all drivers of commercial vehicles must comply with hours of service regulations. The purpose of these laws are to limit the amount of hours drivers can be behind the wheel in a given day or week in order to prevent accidents caused by driver fatigue.
Drivers and trucking companies are required to document hours of service and the U.S. Department of Transportation (DOT) enforces the FMCSA regulations. Drivers or companies that are caught violating regulations or manipulating hours can be suspended of commercial drivers’ licenses or face prison time.
