Orlando trip and fall case settles for $125,000

Client Trips On Uneven Concrete

Our client, a middle aged woman with two beautiful children, was walking on the sidewalk outside of a strip mall in Orlando, Florida. Suddenly and without warning, she tripped and fell on uneven pavement. Over time one side of the pavement drooped down and the cement block next to it shifted up causing about a 2-3 inch wall on the ground. Naturally as our client was walking as a normal person would looking straight ahead and not directly down, she did not see the raise in pavement. The tip of her left foot kicked the uneven pavement and she went down like humpty dumpty… Having a great fall. All the doctors and all the doctors men… couldn’t put our client back together again.

Our Client Undergoes Surgery

She underwent surgery to her right knee but couldn’t make a full recovery. After months of physical therapy with a local therapist, our client was left with a permanent injury to her knee. Our client was offered a complete knee replacement surgery but she refused since such a procedure is very invasive and carries a high amount of risk.

Dell and Schaefer Negotiate A Settlement

After the surgery was done our firm filed a bodily injury demand against the third party carrier’s insurance company for the strip mall. Our firm sought monetary compensation for bodily injury, pain and suffering, loss of consortium, disfigurement, disability, mental anguish, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy negotiation, our firm settled the case for $125,000.
