Publix Slip and Fall on Water Leaking from Cooler

Our client was pushing a shopping cart through the frozen seafood section going toward the dairy aisle of a Publix supermarket in St. Lucie County, Florida. Suddenly and unexpectedly, our client, a 60 year old healthy man, slipped and fell on a puddle of water that had accumulated on the floor as soon as he stepped off a black carpeted mat. He was helped up by a store employee. Upon inspection by our client and the Publix employee, it was apparent that the water was leaking from a newly iced cooler in the frozen seafood section. The water had leaked onto the mat and seeped on the floor. It is important to note that no wet floor signs were posted to alert customers to the danger.

As a result of his fall, our client sustained injuries to his knee and back. He endured a few months of physical therapy, as well as, two intra-articular injections in his knee. At the conclusion of his treatment, his case was prepared and presented to Publix.

Attorneys Dell & Schaefer were clearly able to establish that the dangerous condition was created by Publix and that it was this condition that was the proximate cause of our client’s fall and the injuries he sustained. After a brief period of negotiation the case was settled for an undisclosed figure, and our client was compensated for his medical bills, in addition to the pain and suffering and inconvenience created by this unfortunate incident.
