Slip and Fall Attorneys Dell & Schafer Get $18,000 for Injured Tourist

Tourist Injured in Slip and Fall at Hotel in Boca Raton

Our client, an 80-year-old man from New York was visiting Boca Raton to attend a family wedding. He and his wife were staying at a local hotel for a long weekend where they planned to socialize with family and other guests that were in town for the wedding. Our client and his wife arrived late one night and checked into their room without incident.

The next morning, our client went to take a shower in his guest bathroom, which provided a regular bathtub with a standard shower head. Upon turning on the water and soaping up, he turned around and immediately slipped and fell, banging his face and nose on the top side of the tub before he hit the floor. His nose immediately began swelling and bleeding profusely, which prompted his wife to call the front desk staff who called an ambulance. The paramedics arrived and tended to his injuries before transporting him to emergency room at Boca Raton Regional Hospital. The emergency room physician diagnosed our client with a fractured nose and sutured an external wound before releasing him from the hospital.

Family Contacts and Retains Boca Raton Slip and Fall Attorneys Dell and Schaefer

After our client and his wife attended the family wedding, they returned home to Long Island, New York and contacted Boca Raton Slip and Fall Attorneys Dell and Schaefer. Our attorneys established that the bathtubs in the guest rooms were very slippery and that there were no bath mats or non-skid surfaces in the tubs. The hotel had rubber bath mats available and it appeared that they were placed in most rooms. However, housekeeping had not provided a mat in our client’s guest room.

Attorneys Dell & Schaefer Settle Case with Hotel Insurance Company for $18,000

Thankfully, our client did not need ongoing medical treatment as a result of his injury. Upon returning home, he saw his primary family physician to remove the sutures on his nose. The fractured nose, while initially painful, seemed to have healed quite well. Attorneys Dell & Schaefer presented the medical bills incurred together with the hospital record and photos of the original injury to the insurance company. We alleged that not having bath mats or non-skid strips at the bottom of the tub created a dangerous condition for hotel guests and that it was clearly foreseeable that what happened to our client could easily occur even when being careful.

The hotel acknowledged that housekeeping had failed to provide the bath mat and that tubs could be very slippery without them. The insurance company settled our clients claim for $18,000. Our client was extremely happy with the result but even more satisfied that he did not have to come back to Florida to litigate his case, and that attorneys Dell and Schaefer were able to resolve his case so quickly.

Hello. Had a slip and fall at The Palazzo in Las Vegas on the morning of December 7th. I had taken a shower and noticed the puddle of water on the floor. I put on the slippers the hotel provides and asked the maid for an extra towel she wasnt at my room yet. I put the towel down on the floor and proceeded to stretch the towel out to soak up the water and slipped the slippers apparently didn’t have grip for water. The next day I was having some pain in my left thigh (I wrote right side on the report) and noticed the maid had put a rug in front of the sink which wasnt there the day before. I called the front desk to make a report they transferred me to security and security sent up an EMT. She asked me a few questions asked if I wanted to make a report I told her yes I think I should. She called the engineer to check out the weather strip on the shower he replaced it she gave me some ice packs and they left. I’m not a fraile person so I didnt think it would affect me much but it is. I’m taking Advil for pain and now I’m thinking I need an X-ray. Not sure if I have a case. Risk management from the hotel and I have been playing phone tag…

Gregory Dell:

Ms. Williams,

You may have a potential case, but it will depend on how seriously you are injured. If you have any injuries which you think will be long standing, then you would want to look further into a claim. I hope you are feeling better.

Jean,

The answer to your question depends on various factors. Where did you fall? What was the condition of the steps? Were they defective, broken, wet, etc. We can discuss these issues when you call us.

I was in Las Vegas at January 18th 2014 with my family and a friend in the Venetian’s Casino. When we returned to our room we pushed the button to call the elevator and then the door opened and we took it. There was a mop inside it and also a water recipient one side of the elevator. We took the elevator but there was a lot of water on the floor, reason why I slipped and fell. My family called the desk and they sent the Casino’s paramedic, then they suggested to me that I have to go to emergency because I had some injury at my back and my neck. I say yes and they call 911 and the paramedic of 911 took me to the hospital. They made me some scanning and gave the okay to return to my room but my pain still and I went to see my doctor and I had a MRI and the test result is I have an annular fissure on L4-L5 or a disk desiccation with 2 m.m anterolistheses and mild building posterior annulus. What I need to do, because I’m paying my medical and ambulance bills? Thank you.

I was stepping out of the tub at the Baymont Inn in Arlington, Tx. I had placed a towel in front of the tube. When I stepped out on towel the towel started to slid, I fell, hit the back of my head and hit my left hip against the wall. My husband reported it to the front desk attendant; however he never filled out a report but stated that he was calling the corporate office. My left hip swelled as round as a grapefruit. What do I do from this point?

Jason Macri:

Beverley,

Your fact pattern may be a tough claim since a towel on the floor is common protocol at a hotel. We have seen some hotel cases where the hotel is suppose to have a bar to hold onto when exiting a tub/shower. Please contact us and we will determine if we can help you.

We are staying at a Residence Inn, my son’s house had a pipe break and they had to rip out the kitchen & Bath, and Mom’s house is moldy. Knew the shower was slippery was VERY careful, third shower slipped anyway, caught the handle, propelled me into the glass sliding door. Major concussion. Was so angry, called the desk but Mom is dying in hospital and it was 10 pm and didn’t want to go in ambulance. Got up, head three miles wide, took myself to hospital, was told no driving, no signing anything, nothing. Two weeks later, going to Neurologist, still forgetting which day it is, terrible headaches, can’t multi task, manager didn’t even call to check on me AFTER Hospital documents were turned in. Called because we can’t close on the house WE are buying and they said they wouldn’t charge credit card, but did, desk said “we will have the GM call you”. GM couldn’t even check on me. And I asked for rubber mats, after the impact, they brought towels. Then called again and “funny they had them downstairs”. But after I called about bill, suddenly I have a message from GM on how I am feeling. I am definitely not myself. Almost sent home from work three days ago because of balance issues and head still feels like got hit with a block of cement. Worried about long term damage, balance issues, and they wanted me to sign forms that next day, I couldn’t be in light at all, missed work, no driving, Mom not doing well. Have stayed in more hotel rooms in my life, never experienced anything like this.

I fell late Friday night at a hotel in VA and hurt my back badly but lived on Aleve until I got home to New York, on Sunday, when I went straight to the Emergency Room at the local hospital. I have a very painful thoracic sprain for which hydrocodone was prescribed and which may take three to six weeks to heal. Do I have a case?

Jason Macri:

Eileen,

You may have a case, but we need to speak with you. Can you please call us to discuss the claim. The claim will depend upon what caused you to fall.

Mildred:

I stayed at the Super 8 Motel at Myrtle Beach two days ago, their hot and cold shower is not functioning well, it would be too hot or too cold. So while I was showering the water turned really hot that made me jerk back and slipped and bump my head into the faucet. Plus they don’t have any rubber mats inside the shower. So I had to go to the ER and had my head stitched and I could not go to work because of this injury.

Jason Macri:

Mildred,

Was this incident reported to the hotel? Have you been contacted by their insurance company? Do you have photos of the shower? Please feel free to contact us regarding this incident.

Keri Firestone:

i stayed at a Marriott in Southield MI on 7/31. There was a pipe burst directly above my room in the middle of the night – which no one ever notified me of – and at about 6am I went to the bathroom and slipped upon walking into the bathroom where there was about an inch of standing water and water was leaking in through the vent on the wall. I have a broken foot, that I broke on 7/4 and am allowed to not wear my boot/cast when sleeping, at home etc. I was not wearing the boot and my foot smacked against the side of the toilet, my arm against the side of counter and my right calf against the toilet. My foot is all bruised up and swollen again, and I have scheduled a time to see my doctor about it again. Also, the manager wrote an incident report and gave me a voucher for a future night stay but at this point I feel that I am owed more than that. Do I have a case?

Wednesday, August 5, 2015
Jason Macri:

Hi Keri,

You may have a case against the Marriott and potentially any company in charge of maintaining the pipes. Please feel free to call us so that we can let you know how we can help.

Tamieka:

Greetings, i slipped and fell as i was entering my shower. I hit my head on the tub and which diagnosed as a head injury (slight concussion) per the ER physician. I ended up having someone drive me to the ER and reported the incident to the front desk upon rtn. There were no bath mats available and the non-skid circles are no longer effective. Do i have a case to pursue?

Monday, June 20, 2016
Attorney Jason Macri:

HI Tamieka,

Where is the shower located? Was the shower in your hotel room? When did this incident happen? Do you have any photos of the shower? Did anyone test the non-skid surface? Please feel free to call us to discuss your case further.

Alexis:

The basement floor in my building where I live was wet from a leak caused from a pipe. There was puddle and I slipped sideways and my head slapped against the wall so hard and now head is pounding and my jaw and teeth hurt. I went to the emergency room they said I sustained a head injury and did not want to do a cat scan because of the radiation. They asked me to go home and ice it and asked my best friend who was with me to monitor me. I have the hospital documents and the pictures of the wet floor. Do I have any case?

Tuesday, October 31, 2017
Attorney Jason Macri:
