Small Impact Accident Settles For Large Amount

Our Client Has A Small Fender Bender

Our client, a mid-40’s woman of Russian descent, was stopped at a traffic light in Port St. Lucie, Florida. A medical doctor who was not paying attention slipped his foot off the pedal which caused his vehicle to bump into the back of our client’s car. Because it was such a minor impact, our client decided not to call the police and simply let the doctor leave after he provided his car insurance information. There was no visible damage to the car other than a few scratches. Thinking nothing of it, our client went home.  However, the next morning our client felt some discomfort in her neck. She called a few law firms who decided not to take the case since the police were not called and there was little property damage. However a friend recommended our firm and we quickly took the case. Our firm specializes in low impact and minimal property damage car accidents that result in injury.

Client Seeks Medical Treatment

Our client went to a local chiropractor for her injuries to her neck and back.  The chiropractor placed our client on an intense physical therapy regimen. He also ordered an MRI. The MRI showed slight sprain strain to her neck and back. After several weeks of treatment our client ended care and returned back to normal life.

Dell and Schaefer Negotiate A Settlement

Upon completion of treatment our firm filed a bodily injury demand against the insurance company for the doctor. Our firm sought monetary compensation for bodily injury, aggravation of a preexisting condition, pain and suffering, loss of consortium, disfigurement, disability, mental anguish, property damage, past and future medical expenses, lost wages, and inability to earn future wages. The adjuster for the insurance company continued to make low offers alleging that he could have done more damage by kicking the bumper, than the doctor when the doctors foot fell off the brake pedal. Undeterred by the aggressive tactics of the insurance company our firm filed a lawsuit against the doctor and sought damages in excess of $75,000.

Once the insurance company realized our firm was not joking around and was willing to put the case in front of the jury, their offer increased 700% and we were able to settle the case. Although the details of the settlement cannot be disclosed, our client was ecstatic that our firm went the extra mile for a minor low impact automobile accident.

Attorney Jason Macri:

M. Lipnit, when and where did the incident occur? Did police issue any citations for this crash? Was your husband taken to the hospital by ambulance? If so, were any CT scans, MRI or other images taken at the hospital? When was the full thickness tear revealed? Who is the insurance company for the at-fault party? Feel free to call us so that we can let you know how we can help.
