Client Gets Into An Automobile Accident
Our client, a mid-thirties mother of two was driving her car in Tampa Bay, Florida. Suddenly and without warning another car rear ended her at a high rate of speed. The impact was so great that her car spun around counter clockwise and it came to rest facing in the opposite direction. Dazed and confused and not knowing what else to do she called our firm from the accident scene. The same day as the accident, our client felt pain in her neck and back. She sought the care and medical attention of a local chiropractor in Tampa Bay, Florida. The chiropractor diagnosed her with sprain/strain of the neck and whiplash. He ordered her to under an intense physical therapy regimen. After 2 weeks of treatment without relief from pain, the chiropractor ordered an MRI which showed multi-level herniations up and down her spine. She was then referred to an orthopedic doctor. The orthopedic doctor recommended a surgical fusion to repair the damage to her spine. The client opted not to undergo the procedure.
Dell and Schaefer Negotiate A Settlement
Once the treatment was over our firm filed a bodily injury demand letter with the tortfeasor’s insurance company. Our firm sought monetary damages for bodily injury, pain and suffering, property damage, lost wages, medical bills, disability, mental anguish, and impairment of ability to earn future wages. After a lengthy negotiation, the case resolved for the policy limits.
