Vero Beach auto accident victim obtains $50,000 after hiring Dell and Schaefer

Did you know that a victim can still recover money damages for injuries sustained in an automobile accident even if the victim fails to carry automobile insurance as required by law?

The victim, a 43 year old father of two was driving his car on Interstate 95 when a car suddenly and without warning changed lanes and struck the victim’s vehicle. His vehicle smashed into the cement divider that separates the north and southbound lanes and spun around several times before coming to a complete stop in the middle of the highway. Our client immediately felt pain in his right knee and was taken to the emergency room at the Indian River Medical Center. X-rays and MRI scans taken at the hospital demonstrated a meniscus tear in his right knee. The hospital bill for the X-ray, MRI, and other hospital related bills totaled $10,000. As required by law the hospital sent their bill to the victim’s automobile insurance carrier. The claim was denied because the victim unfortunately failed to pay his insurance premium on time which cancelled the policy. Not knowing what to do and fearing that he would have to file bankruptcy, the victim called the Vero Beach Auto Accident Attorneys Dell and Schaefer.

The Victim’s Injuries Required Surgery

After the accident, our client suffered from pain in his right knee and did not have any insurance available to pay for medical care. Our firm contacted a local orthopedic surgeon in Fort Pierce, Florida and requested for the orthopedist to provide medical care to the client and wait to get paid from the settlement. The orthopedic surgeon agreed and met with our client. After a thorough physical examination, the surgeon recommended surgery to repair the meniscus tear in the knee. Unable to tolerate the pain in his knee, our client decided to undergo the procedure. After the surgery, our client informed us that he was pain free in his knee.

Dell and Schaefer Negotiate A Settlement

Once the recovery was complete post surgery, our firm filed a bodily injury claim against the insurance company of the person that caused the accident for negligently operating a vehicle causing serious bodily injury. Our firm sought money damages for bodily injury, aggravation of a preexisting injury, pain and suffering, loss of consortium, disability, mental anguish, property damage, past and future medical expenses, lost wages, and impairment of ability to earn future wages. After a lengthy negotiation process the claim settled for $50,000. Our client was absolutely thrilled that he was still able to file an injury claim despite his failure to pay his insurance premium on time. In addition, our client did not have to go through bankruptcy due to his large hospital bill, and he was able to surgically repair his knee. In the end, all of his medical bills were paid, his injuries were healed, and he was able to recover a $50,000 settlement!
