Our Client Gets Into An Automobile Accident
Our client, a thirty year old father of two, was exercising reasonable care while operating his vehicle. He stopped at a red light in Wellington and was waiting for the light to turn green. Suddenly and without warning, another vehicle struck him from behind. The accident occurred with such force that our client’s vehicle was pushed into the middle of the road in front of oncoming traffic. Immediately after the accident our client was rushed to a nearby hospital. The hospital diagnosed our client with severe whiplash and recommended that our client follow up with a physical therapist and an orthopedic surgeon. Our client sought the care and medical attention of a local chiropractor. The doctor immediately sent our client out for an MRI. The MRI showed multiple broad based posterior herniations up and down our client’s entire spine. The chiropractor referred our client out to an orthopedic surgeon immediately. The orthopedic surgeon informed our client that no amount of physical therapy will ever heal our client’s injuries. He recommended immediate surgery. Our client had very little options and decided to undergo the procedure.
Dell and Schaefer Negotiate A Settlement
After the surgery, our firm immediately filed a demand letter with the insurance company demanding the policy limits of $250,000. The insurance company offered only $50,000. Our firm quickly rejected that offer. Our firm pulled the photos of the accident showing a complete destruction of our client’s vehicle. In addition we reminded the insurance company that their insured was wasted drunk. We informed them that once we put the pictures in front of the jury and hammer away at the fact that the driver was extremely intoxicated, the jury would absolutely give us a very high verdict. We also stated our firm would seek monetary damages in excess of the policy limits. The insurance company realized they were backed into a corner and immediately tendered out their policy limits.
