Winn Dixie Slip and Fall settles for $50,000 despite not filing a report with the supermarket at the time of the fall

Client Falls on Grapes At Winn Dixie

Our client, a mid-twenties female who suffered from several blood disorders was walking in Winn Dixie with her boyfriend at the time. Suddenly and without warning, she slipped and fell on grapes in front of the cash register. She immediately got up, purchased her items, and left the store without informing anyone of her fall.

Approximately 3-4 days later she began to develop bruises and blood clots all over her body. She went to the emergency room and the doctor informed her that the bruising and blood clots were from a combination of two things—her blood disorder and a traumatic event. He asked her if she suffered any injuries lately. She informed the doctor she had fallen in Winn Dixie. The doctor thought that it was definitely possible that the slip and fall was the cause of her hospital visit. To be safe, the hospital ordered our client to stay for a couple days at the hospital.

Dell and Schaefer Negotiate A Settlement

After our client was released from the hospital our firm filed a bodily injury claim with Winn Dixie. Our firm sought the recovery of the hospital bill as well as money for her injuries and pain and suffering. Winn Dixie originally denied the claim saying they had no notice of the fall and no proof the client was even in the store. Since our client never informed any employees where or why she fell, our firm had to come up with another way to prove our client was in the store. Our firm had our client’s boyfriend produce a copy of his credit card statement showing that a purchase was made at the date and time that we alleged our client fell. Using that credit card statement, our firm was able to convince Winn Dixie that our client was in fact in the store and did in fact suffer an injury. After a lengthy negotiation, the case settled for $50,000.
