Woman hit by car in parking lot of Winn Dixie. Settles case for $28,000.00 with her uninsured motorist carrier

Our client is a senior citizen who was shopping at Winn Dixie in North Miami Beach, Florida. She exited the store pushing a shopping cart with groceries when a car racing through the parking lot hit her shopping basket and knocked her to the ground. The car sped away and left the scene of the accident.
Immediately after the accident, the police came to the scene with fire rescue. Our client suffered multiple bruises and a laceration to her leg. After being treated by paramedics, she went home and a family member took her to the hospital for examination and x-rays. Subsequently, our client started a short course of treatment and therapy to treat her for back pain that resulted from being thrown to the ground.

Our client’s medical bills were covered by her own insurance. Under Florida law, PIP insurance on your personal automobile will cover up to $10,000.00 in medical bills incurred from an auto accident whether you are a pedestrian or in any vehicle. Thankfully, our client had uninsured motorist coverage on her auto policy. This allows her to be compensated for injuries in the event that she is injured in an accident where the responsible party has no bodily injury coverage or insufficient bodily injury coverage. It would also cover injuries sustained in a hit and run accident, such as this case.
Although our client made a pretty good recovery, she was still entitled to compensation for her injuries, pain and suffering and out of pocket expenses. The medical bills and reports together with photographs depicting our client’s injuries were submitted to our client’s UM carrier for evaluation. After a short period of negotiations, our client settled her case for $28,000.00. More importantly for our client, the entire case was resolved in less than 6 months from the date of the accident.
