No Fault Coverage

My teenage son was driving my car and was involved in an auto accident. He had 3 passengers which I did not authorize, and they were all transported to the hospital by ambulance. Who is going to pay all these medical bills?

Under Florida law, each person’s auto insurance company is responsible for paying their own medical bills up to $10,000.00. The fact that you did not authorize your son to have passengers is not relevant. Your (PIP) insurance coverage will cover your son’s medical bills and any of his passengers only if the passengers did not own a car, nor reside with a relative who owned a car at the time of the accident. If your son had teenage passengers who lived with a parent or other relative, their PIP coverage would be responsible to pay for their children’s medical bills. Naturally, if any of the teenagers injured in the accident owned their own vehicle, their own insurance would be primary, regardless of fault and regardless of whose car they were in when the accident happened.
