Who will pay the medical bills I incurred as a result of my slip and fall injury?


Initially, you or your health insurance company will have to pay all expenses related to your injury. Ultimately, all medical bills and lost wages will become part of your claim for damages against the property owner whose negligence was the cause of your injury. In some cases, commercial property owners carry medical payments coverage that will pay medical bills incurred within 1 year of the accident, without having to prove fault on the property owner. This medical payment coverage or “med pay” is very common on homeowners’ insurance policies, but seems to be disappearing from many commercial policies. If no med pay coverage is available, our slip and fall attorneys will have to prove that the defendant property owner was negligent in maintaining their property, and that their negligence was the cause of the injuries sustained. Upon proving this, the defendant insurance company will be responsible to pay any related hospital and medical expenses.

I was in Winn Dixie and water was on the floor. I didn’t see it and slipped through the water and in the process trying to catch my balance from falling I hurt my back and right shoulder. I went to the WE the next day due to bad pain. I had a strained shoulder and pulled muscles in my back. I got all the reports from the ET, now I’m fixing to start going to a pain doctor and Chiropractic doctor for my pain.

I slipped and fell in a parking lot in Publix shopping center it was drizzling out and I slipped and fell. I had a torn rotator cuff along with slip disks. I had an MRI done and went for extensive physical therapy for months I am now going to a pain management clinic. When this first happened my attorney told me to not put my medical bills through my insurance they took a LOP a letter of protection (I think that is what it is called). Now they are changing their minds and telling me that I should put it through my insurance. And they are acting like maybe I don’t have a case because it was raining. When I first went there they said I had a case. I am very upset because you have to put these bills through my insurance company within 3 mos. and it was not done because the paralegal there told the dr. office to hold. Now it is past 3 mos. I have over $10,000 worth of bills and I am terrified I will get stuck with it. I am actually sueing the parking lot not Publix. The parking lot is where I feel. Am I liable for those bills or does the parking lot pay.

We cannot give you specific advice about your case and you should ask questions about your case to your lawyer. Generally we always tell clients to use their insurance if the doctor accepts insurance. A defendant will never be responsible for your medical bills unless they are found to be at fault.

I slipped and fell in a hospital bathroom due to a faulty leaking shower head. The floor was wet and I fell and broke my right arm and injured my left knee . The hospital where I fell has paid all my medical bills thus far but not pain and suffering I am continuing to experience .
I am still in a cast – my third one and my orthopedic wants to order a MRI -possible torn meniscus in my left knee .
Do I have a case for personal pain and suffering compensation ?
