Korey:

Hello. My family and I have been staying in an extended stay hotel in Denver Colorado while we open a new office for our business. This hotel has The Mother Of All Bedbug Infestations! We found out from the bug guy he has been here 100’s of times since the first of the year and cannot fix the problem because the manager refuses to pay or take the appropriate steps. We were infested when the people next to us were moved (for bedbugs) and their room was remodeled. When the bug guy found bug in our room he checked the remodeled room which no one had lived in yet and found the brand new mattress and headboard infested.

I have tons of evidence, have painstakingly documented their negligence (like when they tried to move us to the room next door which had just been found to have an infestation).

The only solution the hotel came up with was to move us to another room. I bought a steamer and steamed all of our stuff before I brought it to the new room but, today my baby is covered in welts again. I’m afraid to just up and move because I will be infesting a new place.

I was thinking of filing suit myself. I noticed that Colorado considers bugs a third party but, these guys have shown sooo much negligence. Can you help or make any suggestions?

I need help. My husband and I are at a Motel 6 in Oklahoma City, Oklahoma. We are here due to waiting on our apartment to be ready. The first couple of nights I just thought they were mosquito bites, then they got worse and I ended up going to the ER to find out and they said it was bed bugs. I have never in my life experienced something with bed bugs. I was advised to call customer service hotline first and they took a formal complaint. Then was advised to talk to management; I went to front office and they said they would not give me my full refund but would only give me $35. The desk clerks were snickering and thought it was funny saying they can’t do that. I explained to them had I known they were bed bugs I would have not stayed here. They offered me another room but I didn’t want to infect anymore rooms. I am lost and really don’t know what to do. I gave them all the money I had; I have no money to go anywhere else. I could use some help, please.

On dec 24 2016 my husband and I stayed in a hotel in tolleson Az Called the Victory Inn. We reported to the front desk clerk immediately after entering our room about what we thought were cockroaches and switched rooms, took pictures of the bugs we seen visibly, after we changed rooms we still woke up in the morning with big huge red itchy whelps all over that eventually led us to go to the hospital for infected bed bug bites and we’re given antibiotics. I do have a few pics documenting the time frame of the initial bites until they got infected, and proof we stayed at the hotel through hotels.com also left a review of the hotel warning others and contacted the health Dept.

This happened at the end of 2016, is it too late to file a case with the court? I’ve had other medical issues to deal with that has prevented me from filing in a timely matter as well as we live in Colorado but do have a house in Az that we rent out but currently vacant Due to renovations, scariest thought was transferring them into my rental property, having that happen to us on Christmas Eve and Christmas Day ruined our holiday and everyone could see the bites and scabs all over us which was highly embarrassing. Also didn’t have medical coverage there, so I had to pay full price for the antibiotics for both my husband and I which I have all receipts for as well as the medical report from the hospital confirming they were in fact infected bed bug bites.

Grant Schwarz:

Kimberly, has this incident been reported to anyone at the hotel after you checked out? Have you spoken to management or the owner to let them know about your bed bug bite injuries? Did the health department confirm bed bugs in the room? There is a lot of work that needs to be done to properly investigate your case. Arizona has a 2 year statute of limitations to file a lawsuit in court. The statute for your case will expire December of this year. That does not leave a lot of time to build your case. This is especially true since this happened December 2016. It is possible that the hotel has changed owners. We have even seen cases where the hotel building has been demolished during the period of the statute of limitations. There are a lot of concerns for your case. Our suggestion would be to contact a local attorney in AZ to get busy quickly if you want to have a chance at investigating the matter properly and filing a lawsuit. Best of luck.
